Types of Property Use Arrangements

Parishes should select the correct property use arrangement depending on the nature of the proposed external party activity.

Lease

  • Grants exclusive possession of a property
  • Typically for a fixed term
  • Creates a legal interest in land
  • Best suited to longer-term or commercial arrangements

Licence

  • Grants permission to use property (not possession)
  • Usually short-term or shared use
  • More flexible and easier to terminate
  • Appropriate for community activities, shared arrangements, or recurring use

Hire Agreement

For casual, occasional, or one-off use (e.g. birthday party, meetings, community events) use a simple hire agreement (below) that at a minimum includes date and time of use; description of the activity, fee and payment terms, responsibility for cleaning and damage, insurance requirements, contact and supervision arrangements.
