Interment Contracts

Model Contract

The model consumer contract for a Perpetual Interment Right, published by Cemeteries & Crematoria NSW (CCNSW), is non-mandatory but has been designed to comply with Licence Conditions A.

This contract applies to:

  • A single interment right
  • A single interment site

Note that a single interment site may allow for multiple interments, depending on site capacity and cemetery rules.

Contract Structure

The model contract consists of seven key components:

  1. Agreement Statement — A summary of the key elements of the contract.
  2. Part A — Details relating to the interment right.
  3. Part B — Details of the interment service (burial or ash interment) and any related services (e.g. memorials, chapel services).
  4. Part C — Consolidates Parts A and B to confirm pricing and payment terms.
  5. Declarations and Signatures
  6. Annexure A – Terms and Conditions
    Mandatory for all licence categories, as required by the licence conditions.
  7. Annexure B – Price Breakdown
    Mandatory for Category 1 and Category 2 licences only.

Together, these components satisfy all requirements of Licence Conditions A. Additional annexures may be included where necessary to document extra services or parish-specific provisions.

Contract Templates

The Anglican Property Trust has prepared electronic Contracts for Sale of a Perpetual Interment Right for parish use. These contracts may be completed and signed electronically using Adobe Reader, in accordance with the Electronic Transactions Act 2000 (NSW).

Parishes should select the appropriate template based on:

  • When interment and related services are charged (now or in the future), and
  • Whether there are multiple rights holders and/or multiple people to be interred.

Instructions for Completion

Ensure that all relevant sections of the contract are completed, including:

  • All required dates and prices in Part C
  • Parish contact details in Annexure A, section A6(d)

Incomplete contracts may result in compliance issues
